Terms of Service for the McFarlane Toys Digital Digital Collectibles Platform

 

Welcome to McFarlane Toys Digital (MTD), a digital collectibles platform that leverages the Polygon blockchain for the creation, purchase, and sale of NFTs (Non-Fungible Tokens). By accessing or using the MTD services, you agree to comply with and be bound by these Terms of Service (“Terms”). Please read them carefully.

1. Acceptance of Terms

By using our platform, you acknowledge that you have read, understood, and agree to these Terms, including our Privacy Policy and any other policies referenced herein. If you do not agree with these Terms, please do not use our services.

2. Eligibility

To use our platform, you must:

  • Be at least 18 years of age or the age of legal majority in your jurisdiction.
  • Have the legal capacity to enter into a binding contract.
  • Not be barred from using the platform under any applicable laws.

3. Account Registration

  • Account Creation: To access certain features of the platform, you must register for an account. You agree to provide accurate, current, and complete information during the registration process.
  • Account Security: You are responsible for maintaining the confidentiality of your account login information and for all activities that occur under your account. Notify us immediately of any unauthorized use of your account.

4. Digital Collectibles (NFTs)

  • Ownership: NFTs purchased on MTD are stored on the Polygon blockchain. Ownership of NFTs is mediated entirely by the blockchain.
  • Purchases: You may purchase NFTs using a credit card, cryptocurrency, or other payment methods we support. All transactions are final and non-refundable.

5. Use of the Platform

  • Prohibited Activities: You agree not to engage in any activities that:
    • Violate any laws, regulations, or these Terms.
    • Infringe on the rights of others, including intellectual property rights.
    • Introduce viruses or other harmful software.
    • Use bots or other automated means to access the platform.

6. Payments and Fees

  • Transaction Fees: All transactions on the platform may be subject to fees, including but not limited to transaction fees, gas fees, and platform fees. These fees will be disclosed at the time of the transaction.
  • Payment Methods: We accept payments via credit card, supported cryptocurrencies, and other methods as specified on the platform.

7. Discord Community

  • Community Guidelines: Our Discord community is a place for users to connect and share. You agree to adhere to our community guidelines, which prohibit harassment, hate speech, and any form of abusive behavior.
  • Moderation: We reserve the right to moderate and remove any content that violates our community guidelines or these Terms.

8. Intellectual Property

  • Platform Content: All content on the platform, including text, graphics, logos, and software, is the property of MTD or its licensors and is protected by intellectual property laws.
  • User Content: By submitting content to the platform, you grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, and display your content in connection with the platform.

9. Termination

  • Termination by You: You may terminate your account at any time by contacting us.
  • Termination by Us: We may suspend or terminate your account if you violate these Terms or engage in any prohibited activities.

10. Limitation of Liability

To the maximum extent permitted by law, MTD and its affiliates, officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, goodwill, or other intangible losses, resulting from:

  1. Your access to or use of or inability to access or use the platform;
  2. Any conduct or content of any third party on the platform;
  3. Any content obtained from the platform;
  4. Unauthorized access, use, or alteration of your transmissions or content.

11. Governing Law

These Terms are governed by and construed in accordance with the laws of Arizona, without regard to its conflict of law principles. You agree to submit to the personal and exclusive jurisdiction of the courts located within Arizona to resolve any dispute or claim arising from these Terms or the use of the platform.

12. Changes to Terms

We reserve the right to modify these Terms at any time. Any changes will be effective immediately upon posting the updated Terms on the platform. Your continued use of the platform after any such changes constitutes your acceptance of the new Terms.
